9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL METHODVITZ OR ITS OFFICERS, PARTNERS, EMPLOYEES OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM (OR, IF YOU HAVE NOT PAID US, USD 100).

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict of laws principles. Any dispute arising out of or relating to these Terms will be resolved exclusively in the state or federal courts located in Mumbai, India, and you consent to personal jurisdiction in those courts.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be struck and the remaining provisions will remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Services, constitute the entire agreement between you and Methodvitz regarding the Services and supersede all prior or contemporaneous communications.
